SmartRecruiters only collects personal data that is necessary for our activities. As a Website Visitor, we may collect different types of data directly from you or through third parties such as:

Browsing data collected via implemented cookies in accordance with the Cookie Policy and connection data related to the use of our services (such as Google Advertiser ID or IDFA, device information, the UUID, crash data, etc.);

The purposes of processing

Depending on the applicable law, the Processing of Personal Data may be subject to a requirement to state and justify the reason for processing, sometimes referred to as the “legal basis”.

Smart Recruiters’s compliance with statutory obligations:

Smart Recruiters processes your Personal Data for the purpose of ensuring an adequate level of technical and organizational security of Smart Recruiters’s products, services, online events, facilities, and premises. For this, Smart Recruiters will take the measures necessary to verify or maintain the quality and safety of a product or service which is owned, manufactured by or for, or controlled by Smart Recruiters. This may comprise the use of Personal Data for sufficient identification and authorization of designated users, internal quality control through auditing, analysis, and research, debugging to identify and repair errors that impair existing or intended functionality, account and network security, replication for loss prevention, detecting security incidents, protection against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for such kind of activity.

Smart Recruiters processes Personal Data (name, surname, country, IP address) to the extent necessary to fulfil sanctions and embargo requirements under European Economic Area (“EEA”) laws to which Smart Recruiters is subject, and laws and regulations extraterritorial to the EEA (based on Smart Recruiter’s legitimate interest).

Where necessary, SmartRecruiters uses Personal Data to prevent or prosecute criminal activities such as any form of cybercrime, the illegal use of Our products and services or fraud, to assert Our rights or defend SmartRecruiters against legal claims.

To comply with data protection and privacy laws (e.g. to respond to your data subject request) and unfair competition laws. Depending on the country in which the relevant SmartRecruiters operate, SmartRecruiters may process Personal Data necessary to accommodate your data protection and privacy choices for the receipt of such information and, when necessary, to ensure compliance.

Means of collection and data recipients

You may directly provide your personal information when you submit requests via any collection forms on SmartRecruiter’s website. Some Data may also be collected indirectly while you are browsing our website through trackers under the conditions defined in the Cookie Policy available on our website.

Depending on the function, and if you give your express consent, data is passed on to up to 52 third parties and processed by them. This consent is voluntary, not required for the use of our website and can be revoked at any time using the icon on the bottom left.

Data retention periods

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose they have been collected for and may be retained for longer due to applicable legal obligation or based on the Users’ consent.

Therefore:

Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.

Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to fulfil a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

SmartMessage Service Terms and Privacy Choices

  • Upon opting in to the SmartMessage service, SmartRecruiters will send a confirmation message to the registered mobile number. Consent may be provided at the time of job application by supplying a phone number on the application form, or by following the consent link sent via email when a Candidate is added to the system by a recruiter or via API. By opting in, the User consents to receive informational text messages from the hiring organisation powered by SmartRecruiters, including interview scheduling invitations, reminders, application status updates, and outcomes. Consent is not a condition of purchase. Message and data rates may apply. Message frequency will vary. Text “HELP” for help. Text “STOP” to cancel.
  • You can cancel this service at any time. Just text “STOP” to opt out. After you send the message “STOP” to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages from us.
  • If you want to join again, just text “START” and we will resume sending messages to you.

    • If at any time you forget what keywords are supported, just text “HELP”. After you send the message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
  • Carriers are not liable for delayed or undelivered messages.

  • We do not share consumer opt-in consent with any 3rd parties. Mobile data consent will not be shared with any 3rd parties through this SMS channel.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. Such requests are free of charge and will be answered by the Owner as early as possible and always within one month, providing Users with the information required by law. Any rectification or erasure of Personal Data or restriction of processing will be communicated by the Owner to each recipient, if any, to whom the Personal Data has been disclosed unless this proves impossible or involves disproportionate effort. At the Users’ request, the Owner will inform them about those recipients.
